Privacy Policy

This policy explains how Oxygn collects, uses, shares and protects your personal information, and the rights you have over it. We have written it in plain language, in line with the Protection of Personal Information Act, 2013 (POPIA).

1. Who we are

 

1.1  Oxygn ISP (Pty) Ltd (“Oxygn”, “we”, “us”) is a licensed internet service provider. We are the responsible party for the personal information described in this policy.

1.3  This policy applies to our website, our sign-up process, and the services we provide. It works alongside our Terms and Conditions, Acceptable Use Policy and PAIA Manual.

 

 

2. The information we collect

 

We collect only what we need to provide your service, meet our legal obligations, and run our business. This includes:

3. How and why we use your information

 

3.1  POPIA requires us to have a lawful basis for using your information. We rely on the following:

3.2  We do not sell your personal information to anyone.

 

 

4. Who we share your information with

 

4.1  We share personal information only where it is necessary, and only with parties who are required to protect it. These are:

  • Network Operators (FNOs) — The fibre Network Operator serving your address (for example Openserve, Vumatel or MetroFibre), so they can install, maintain and resolve faults on the line. This is the sharing you consent to in our Terms and Conditions, and we share only what is needed for those purposes.
  • Payment partners — Banks and payment processors who handle your debit order and payments.
  • Service providers — Trusted contractors and service providers who help us deliver, support or improve the service, under confidentiality and data-protection obligations.
  • Authorities, where required by law — Law enforcement, regulators or courts where we are legally required to do so — including under RICA — or to protect our rights.

4.2  Where any of these parties are outside South Africa, we take reasonable steps to ensure your information receives a comparable level of protection, as POPIA requires.

 

 

5. How long we keep it

 

5.1  We keep your personal information only as long as needed for the purposes above, or as required by law. RICA and tax/financial records are kept for the periods those laws require, even after you leave us.

5.2  When information is no longer needed and we are not required to keep it, we securely delete or de-identify it.

 

 

6. How we protect your information

 

6.1  We take reasonable and appropriate technical and organisational measures to protect your personal information against loss, unauthorised access and misuse, as POPIA requires.

6.2  No system is perfectly secure. If a data breach affects your personal information, we will notify you and the Information Regulator as the law requires.

 

 

7. Your rights

 

7.1  Under POPIA you have the right to:

  • Ask what personal information we hold about you, and request access to it.
  • Ask us to correct or update information that is wrong or out of date.
  • Ask us to delete information we are no longer entitled to keep.
  • Object to certain uses of your information, including marketing.
  • Withdraw consent where we relied on it (this won’t affect uses with another lawful basis, such as RICA).
  • Complain to us first at hello@oxygn.co.za, and to the Information Regulator if you are not satisfied.

8.1  Our website uses cookies and similar technologies to make the site work, remember your preferences, and understand how the site is used so we can improve it.

8.2  You can control cookies through your browser settings. Disabling some cookies may affect how the site works. Where required, we will ask for your consent to non-essential cookies.

 

 

9. Changes to this policy

 

9.1  We may update this policy from time to time. We will post the current version on oxygn.co.za, and material changes will be communicated to you. The date at the top shows when it was last updated.
