Oxygn ISP Acceptable Use Policy
1. Introduction
1.1. Oxygn ISP (“Oxygn”) is committed to maintaining a secure, fair, and open internet for all customers. By using Oxygn’s services, customers agree to comply with this Acceptable Use Policy (“AUP”) and are responsible for ensuring their users do the same.
1.2. This policy aims to protect our network, safeguard customer usage, and uphold the highest standards of integrity.
1.3. Oxygn reserves the right to amend this policy at any time by posting updates on our website. Continued use of our services after any updates signifies acceptance of the revised terms.
2. Scope
2.1. This AUP applies to all Oxygn services that provide or facilitate internet access, hosting services (including web, data, and server hosting), and other related services (collectively referred to as “Services”).
3. Prohibited Activities
3.1. Unlawful or Harmful Use
3.1.1. Engaging in illegal activities, including any violation of local, national, or international laws, is strictly prohibited.
3.1.2. Promoting violence, hate speech, or inciting criminal acts is forbidden.
3.1.3. Using Oxygn’s network to engage in fraudulent activities, defamation, or to publish offensive, obscene, or discriminatory material.
3.1.4. Any action that compromises the stability or availability of Oxygn’s network or connected systems, including unauthorized access attempts or network disruption, is prohibited.
3.2. Violation of Intellectual Property Rights
3.2.1. You may not use the Services to host, share, or distribute any material that infringes copyright, trademarks, patents, trade secrets, or other proprietary rights without the appropriate authorization.
3.3. Spam and Email Abuse
3.3.1. Sending unsolicited bulk emails, advertising messages (spam), chain letters, or fraudulent messages via Oxygn’s network is prohibited.
3.3.2. Unauthorized collection of email addresses or relay of emails without permission, including unsolicited mass messaging, is prohibited.
3.4. Network Interference
3.4.1. Deliberately attempting to disrupt Oxygn’s network or any other connected systems through malicious means, including, but not limited to, overloading bandwidth, launching DDoS attacks, or infecting systems with viruses or malware.
3.4.2. Running unauthorized servers (e.g., web, email, file-sharing, or gaming servers) without express consent from Oxygn, unless subscribed to a package that allows this.
3.5. Inappropriate Content
3.5.1. Hosting, transmitting, or promoting material that is harmful, obscene, or indecent.
3.5.2. Uploading or distributing any content related to child pornography or any form of exploitation of minors.
3.6. Security Violations
3.6.1. Unauthorized access, monitoring, or scanning of Oxygn’s or third-party systems, including hacking, phishing, and distribution of malicious software.
3.6.2. Impersonation of others or stealing credentials for malicious purposes.
3.6.3. Using software tools intended to breach network security or intercept data.
4. Fair Use and Resource Allocation
4.1. Personal and Business Use
4.1.1. Oxygn’s residential services are intended for personal use only. Reselling services or using personal plans for commercial activities is prohibited unless specified under a business package.
4.1.2. Business customers should operate within the agreed bandwidth and usage limitations. Exceeding these limits may lead to restrictions, suspension, or termination of services.
4.2. Network Management
4.2.1. To optimize network performance, Oxygn may implement bandwidth management practices, such as adjusting traffic priorities or limiting specific data types during high-traffic periods.
4.2.2. Continuous uploading/downloading of large files (e.g., video/audio streaming, FTP traffic) in excess of the allocated quota is not allowed without prior agreement.
4.3. Shared Resources
4.3.1. Customers must ensure their usage does not negatively impact the experience of others. Excessive use of network resources, engaging in activities that degrade network performance, or bypassing agreed limits is strictly forbidden.
5. Customer Responsibilities
5.1. Customers are accountable for all actions undertaken by their users and must ensure adherence to this Acceptable Use Policy.
5.2. If Oxygn becomes aware of any violations, customers must take immediate corrective action to prevent future occurrences.
5.3. It is the Customer’s responsibility to maintain secure configurations for their devices, preventing any unauthorized use of Oxygn’s services.
6. AUP Enforcement
6.1. Violation of this AUP may result in any of the following actions:
6.1.1. Warning and Notification: Oxygn may issue a formal warning or notice to address the violation.
6.1.2. Suspension or Termination: Repeat or significant violations may lead to service suspension or termination without advance notice.
6.1.3. Financial Liability: Customers may be held responsible for additional costs or damages incurred due to the breach, including bandwidth overages and administrative costs.
6.1.4. Legal Action: In severe cases, Oxygn may initiate legal proceedings, or cooperate with law enforcement, to address illegal or harmful activities.
6.2. Oxygn reserves the right to monitor traffic and content to ensure compliance with this AUP. However, Oxygn has no obligation to actively monitor the use of its Services.
7. Incident Reporting and Support
7.1. Any incidents or complaints regarding violations of this AUP should be reported to hello@oxygn.co.za. Please provide as much information as possible to assist in the investigation and resolution of the matter.
8. Interactions with Oxygn Staff
8.1. Abusive, aggressive, or offensive behaviour toward Oxygn staff, whether on public platforms or in direct communications, may result in suspension or termination of services.
